==============================ضلع اعظم گڑھ کے قصبہ بلریا گنج میں گزشتہ ماہ فروری میں خواتین کے ذریعہ این پی آر و این سی آر کے خلاف جاری احتجاجی مظاہرہ کو پولیس نے رات کے اندھیرے میں وحشیانہ طور پر طاقت کا استعمال کرتے ہوٸے ختم کرا دیا تھا۔اس دوران پولیس نے بے گناہ لوگوں کو گرفتار کرکے ان کے اوپر سنگین دفعات میں مقدمہ داٸر کر کے جیل کے اندر ڈال دیا۔جس میں بشمول مولانا طاہر مدنی 19 افراد کو حراست میں لیا گیا تھا۔
ان افراد کی ضمانت سی جے ایم و ضلع جج سے خارج ہونے کے بعد معاملہ ہاٸی کورٹ پہنچا ۔اسی دوران کورونا واٸرس کی وبإ کیوجہ سے ملک میں لاک ڈاٶن کا اعلان ہوگیا۔جس سے ان لوگوں کی ضمانت عرضی داخل ہونے میں تاخیر ہوٸی۔
کچھ دنوں قبل پہلے مولانا طاہر مدنی صاحب کی ضمانت عرضی داخل کی گٸی ۔فرضی مقدمہ کے علاوہ صحت و ضعیف العمری کو بنیاد بنایا گیا۔ہاٸی کورٹ نے ان کی ضمانت منظور کر لی اور وہ اب جیل سے باہر ہیں۔۔اس کے بعد سب سے کم عمر ملزم سلمان عمر 17 سال کی عرضی داخل کی گٸی جو کہ مورخہ ٢ جون کو منظور ہو گٸی اور کاغذی کارواٸی کی تکمیل کے بعد آج سلمان کی رہاٸی ممکن ہے۔
اس کے بعد مزید چار لوگ خان ریاض ،
محمد یوسف ، ضیإ الرحمٰن اور عامر نسیم کی ضمانت عرضی داخل کی گٸی جسکو آج ہاٸی کورٹ نے سلمان کی ضمانت کا حوالہ دیتے ہوٸے منظور کر لیا۔اگلے ہفتہ تک ان لوگوں کی رہاٸی بھی ممکن ہو سکے گی۔
مولانا طاہر مدنی کے مطابق مزید 5 لوگوں کی ضمانت عرضی داخل کی گٸی ہے جس میں شہاب ، تہذیب ، حکیم ، عبد الرحیم و عامر نسیم کے نام شامل ہیں۔ ان 5 لوگوں کی فاٸل مورخہ ٨ جون بروز دوشنبہ کو سماعت کے لٸے لگی ہوٸی ہے۔

Application is allowed.
Order on the Bail Application
In view of the guidelines laid down by this Court,
the urgent bail applications have been directed to
be heard through Video Conferencing.
Heard learned counsel for the applicants and
learned A.G.A. through Video Conferencing.
The co-accused, Salman, has been enlarged on
bail vide order dated 2.06.2020 in Criminal Misc.
Bail Application No. 13075 of 2020. The prayer for
release of the applicant on bail on the ground of
parity has been made. The applicants are
languishing in jail since 5.2.2020.
Keeping in view the nature of the offence,
evidence on record regarding complicity of the
accused, larger mandate of the Article 21 of the
Constitution of India and the dictum of Apex Court
in the case of Dataram Singh Vs. State of U.P. and
another reported in (2018)3 SCC 22 and without
expressing any opinion on the merits of the case,
the Court is of the view that the applicants have
made out a case for bail. The bail application is
allowed.
Let the applicants, Yusuf, Arqam, Ziaur Rahman
and Khan Rayyan, who are involved in Case Crime
No. 14 of 2020, under Sections 147, 148, 149,
124A, 153A, 504, 505, 506, 188, 332, 333, 336,
186, 353, 307, 120-B I.P.C, and 2/3 Prevention of
Damage to Public Property Act and section 7 Law
Amendment Act Police Station-Bilariaganj , DistrictAzamgarh, be released on bail on their furnishing a
personal bond and two sureties each in the like�
mount to the satisfaction of the court concerned
subject to following conditions. Further, before
issuing the release order, the sureties be verified.
1. The applicants shall not tamper with the
prosecution evidence by intimidating/ pressurizing
the witnesses, during the investigation or trial.
2. The applicants shall cooperate in the trial
sincerely without seeking any adjournment.
3. The applicants shall not indulge in any criminal
activity or commission of any crime after being
released on bail.
4. In case the applicants has been enlarged on
short term bail as per the order of committee
constituted under the orders of Hon'ble Supreme
Court his bail shall be effective after the period of
short term bail comes to an end.
5. The applicants shall be enlarged on bail on
execution of personal bond without sureties till
normal functioning of the courts is restored. The
accused will furnish sureties to the satisfaction of
the court below within a month after normal
functioning of the courts are restored.
6. The party shall file computer generated copy of
such order downloaded from the official website of
High Court Allahabad.
7. The concerned Court/Authority/Official shall
verify the authenticity of such computerized copy
of the order from the official website of High Court
Allahabad and shall make a declaration of such
verification in writing.
In case of breach of any of the above conditions, it
